Digital Camera + Movies = Jail Time for Teen?

Where a teen goes, often goes a phone and a digital camera. Even to the movies, it seems. But teens who are at ease recording the many moments of their lives need to be well versed in copyright law.

A 19-year-old Virginia teen on a movie date to celebrate her birthday was arrested after unthinkingly recording about 20 seconds of the movie "Transformers" to show her 13-year-old brother, according to the Washington Post. She was charged with illegally recording a motion picture, and the Regal Cinemas is pressing ahead with the suit. She faces up to a year in jail and a $2,500 fine for recording the 20-second segment.

It was wrong, clearly, to record any of the movie, and it was not a smart move. But for the theater company to move ahead with this particular lawsuit to prove the industry's zero-tolerance policy is equally ridiculous. As Cindy Cohn, general counsel of the Electronic Frontier Foundation, tells the Post, the motion picture industry needs to stop treating fans like criminals. Sejas, a Marymount University student, was actually promoting the movie, not stealing it.

The Post reports that pirating movies costs the motion picture industry $18.2 billion a year, and 90 percent of illegally distributed films are recorded by camcorders, according to the Motion Picture Industry of America. But Sejas recorded seconds of the movie with a Canon PowerShot, her boyfriend's sister's digital camera. Even if that short clip made it onto the Internet, it is difficult to see how it could enrich Sejas.

Either way, warn your teens to keep the cameras off and away when at the movies. Or they may find a police officer beckoning them from their seats and into a legal mess.

Actually, the "fair use" component of copyright law says that excerpts (usually limited to 10% of the total) can be used for critical reviews. She should post a review online and use the clip to illustrate; voila! no violation, no foul.

Would Regal Theaters punish someone for keeping a copy of a movie trailer that's commonly available on the internet? I think not. They should apologize and creep back under their rock. Until this issue is settled I will NOT attend another film at ANY Regal Theater.

Go to Regal Entertainment Group and file a complaint with them. Even if it doesn't work they will find out how we feel about it and how I plan to not use their facilities as long as they act this stupid. The girl was helping them sell this movie to her brother and probably his friends. They should get 'flippin' real..

I live far away from America butI would want Regal Cinema to realise that the teen was just showing love to her brother and also enticing him to go and watch for himself. If this is not promoting their cinenma what is it? Do not always think about money. For once see the love and caring side of this issue and allow the girl to go free. There are very few young people who think aout their siblings when they are enjoying themselves.

This is total bull. $2500 and a year ripped away from her childhood for a 20 second clip? They're just begging people to download movies from the internet with action like this. I say do one better and never visit another Regal Cinemas theater again. I know I won't.

This poor girl! There was no intent to deceive or gain here, she just wanted to show her brother. I cannot believe that this company is being so cruel.

REGAL CINEMAS; SHAME ON YOU! ! ! ! NO WONDER EVERYBODY HATES YOU! FIRST, YOU CHARGE A CRIMINAL AMOUNT TO SEE A MOVIE (PRODUCED AND FUNDED BY MILLIONAIRES, I MIGHT ADD) THEN CHARGE A POOR SHMUCK AROUND $20 A HEAD TO SEE A MOVIE, THAT IN A YEAR OR TWO NO-ONE WILL CARE ABOUT ANYWAY! WOULD YOU LIKE POPCORN WITH THAT? HOW ABOUT $4.50 A BOX? ANOTHER 3 TO 4 DOLLARS A SODA , AND THERE YOU GO. THE PERFECT $100 DATE THAT JOE SHMOE JUST SPENT TO IMPRESS A GIRL WHO (A)DIDN'T LIKE THE MOVIE, (B) DIDNT LIKE THE STALE POPCORN AND WATERED DOWN SODA, ..AND (C)ONLY WENT ALONG TO MAKE JOE SHMOE FEEL BETTER. BUT JOE SHMOE FEELS WORSE , BECAUSE HE (a)SPENT 100 BUCKS OF HIS HARD EARNED MONEY IN JUST TWO HOURS OF HIS LIFE (ALTHOUGH IT TOOK MAYBE 20 HOURS OF HIS LIFE TO EARN THE MONEY, BECAUSE JOE SHMOE IS NOT A MILLIONAIRE! (b) WORRIES IF HE HAS THE GAS TO MAKE IT HOME TONIGHT(C)HAS EATEN A BUCKET OF POPCORN WHICH HAS NO NUTRITIONAL VALUE, NOR DOES THE SODA AND (D)IS PROBABLY GOING TO SPEND THE NEXT 20 HOURS OF HIS LIFE WONDERING WHAT HE DID WRONG TAKING HIS DATE TO THE MOVIE WHERE SHE WAS NOT MUCH IMPRESSED. MAYBE HE SHOULD HAVE TAKEN HER TO A RESTAURANT WHERE HE MIGHT ACTUALLY LEAVE THE BUILDING WITH A FULL STOMACH TO COMPLIMENT HIS EMPTY HEAD. ..MAYBE THE MOVIE INDUSTRY HAS BEEN RIPPING AMERICA OFF FOR TOO LONG WITH THEIR $100-MILLION-DOLLAR-WEEK-AT -THE-BOX-OFFICE LIFESTYLES WHILE THE REST OF US ARE EATING GOVERNMENT CHEESE AND STALE BREAD. MAYBE IF THEY HAD THE BRAINS TO DO IT; THEY WOULD PURSUE THE PEOPLE WHO RENT AND CLONE MOVIES AT HOME, OR THE ONES WHO HAVE ACCESS TO A THEATER AND A CAMCORDER ON A TRIPOD , THEY ARE THE ONES BILKING THE INDUSTRY ...NOT SOME KID WITH A CELLPHONE. .....I SINCERELY HOPE THE JUDGE THROWS THIS FRIVILOUS LAWSUIT OUT OF COURT. I HOPE THE JUDGE THROWS YOU OUT OF COURT, I HOPE PEOPLE BOYCOTT YOUR LOUSY,DANK, POPCORN STREWN THEATERS ALTOGETHER,I HOPE YOU PEOPLE GET A CONSCIENCE BEFORE YOU DIE FOR YOUR OWN SAKES! I WILL MAKE IT A POINT TO TELL ALL OF MY FRIENDS TO N-E-V-E-R GO TO A REGAL CINEMA AND I WOULD BE ONLY DELIGHTED TO TELL THEM WHY.IN FACT; I WILL E- MAIL MY FRIENDS STARTING RIGHT NOW! SHAME ON YOU!! POOR LITTLE RICH MOVIE MOGULS!!!

Zero tolerance for zero tolerance. Isn't it time we realized that in order for laws to be just, they must be tempered with wisdom and mercy. Zero tolerance denies what the civilized world has known for centuries. Enforcement of the law, wheather criminal or civil must be done on a case by case basis. The world, and the people who live in it are far too large and diverse for us to try and enforce any law as a zero tolerance law, there can be no justification in trading our fears as a society for the justice of the individual. We can never legislate away tragedy, Let's not trade justice for a false sense of security. Keep America Free!!!

Given the cost of a movie ticket these days, theaters need to be doing things to appear to be the better choice, not the worse. My fiancee and I already think to ourselves "Why spend $10 a seat for a movie when we can buy the DVD for less than $20?" Theaters doing things to get a bad image will only decrease the already waning industry.

What they are refering to is that the movie belongs to the owner, and NO PART CAN BE COPIED!!!!!!!!!!! How would you to have a person copy part of your term paper...and promise not to use it?????? After you have been lied to and had billions stolen from you, they had to do something to protect themselves. It was probably an 18 year old asst manager trying to make himself look good. I don't agree with what they did, but I see why they did it.

She paid to see the movie. The company should be grateful. I hope she never returns to give that company more patronage. This is rediculous. The prudent man accessment of law should rule.

Good example that shows that when it comes to losing millions the movie industry does not care even about children. We put money before the kids. Very "nice" and "ethical" business!
