Apple and AT&T sued for selling too many iPhones

As complaints over dropped calls and slow performance continue to nag Apple following its iPhone 3G launch, at least one man has become angry enough to file a lawsuit, saying that Apple and AT&T have misled consumers by not just selling a device that "requires too much power" but that the two companies have sold so many devices that they are now flooding the AT&T network and slowing it down for everyone.

The idea of flooding a cellular network isn't far-fetched, but so far there's only limited evidence that this is really happening. (I expect we won't likely know the extent of any such issue until iPhone 3G sales start to peak.) But the litigious William Gills has this response covered too, saying that even without the flooding, Apple has exaggerated performance data since the launch of the first iPhone, complaining that it never performed as well as the company said it would even on the old EDGE network.

For its part, Apple has defended performance on the handsets and as "great," but this is actually the second lawsuit the company has attracted in the last couple of weeks from upset buyers. Both suits appear to be seeking class action status.

While every new product invariably seems to attract lawsuits when expectations don't measure up exactly to what was promised in advertising, the iPhone has sold so many handsets so quickly that it's getting more than its fair share of attention from the legally minded.

There's no telling whether these suits will stick, but given the growing mountain of gripes on the web, it's hard to imagine we won't see Apple and AT&T offering some kind of settlement to iPhone buyers down the road. (My bet for what they'll eventually get in, oh, three years or so: a $10 credit at the iTunes Store.)

    the iphone is slow but not completely bad. whats horrible is at&t . their service sucks, because... well there is never any service. why apple would choose to sell exclusivly through at&t is just stupid. at least if thy sold through verizon peploe would be happy with the service they get.

    Like or hate the iPhone, or Apple, everyone should be able to admit that this lawsuit is stupid and completely without merit. A better solution would be to round up these worthless lawyers who do this, their client, and any morons who agree with this kind of nuisance lawsuit, and use them as boat anchors.

    I mean yeah...the iPhone is pricey,the lines are pricey,but really,thats stupid.Nowadays,people sue for almost anything that they can think of

    i agree with 8 and 9. this is one of the most absurd law suits i have ever heard of and its these money hungry pieces of (explitive) that are destroying our legal system. if your unhappy with your over priced phone too dam bad. should have thought about that before you spend all that money in the first place.

    This is just plain ignorant. I am not an Iphone fan nor am I an AT&T fan. But you have to blame the people that bought the product without doing the proper research. Apple and its marketing staff did their jobs but the consumers did not do theirs. Anytime there is a contract involved, you need to Read, Study and learn about the products and carriers before signing your name. If you don't, you become the partner in crime not the victim.

    This is for #7. Apple went to Verizon first. Verizon did not want to deal with Apple so they declined. From the report I heard, Apple wanted them, but put so many restrictions on it Verizon said, "Thanks, but no thanks."

    didn't realize so many malcontents had a gun put to their heads forcing them to buy an iphone! i have one and love it. i guess they can just go watch the new seinfeld/gates ads. another example of microsoft losers.

    what is sad is I am a apple nut but i hate the iphone .its to locked down .... apple needs to sell a fully unlocked version for $500 then we pick the cariers # 12 is right READ THE CONTRACT !!!!! and try BEFORE you buy borrow a friends .. if apple sold the iphone on more networks it would put less load on ATTs back bone it would spread the load !!! and that would solve the lawsuit... simple ......

    Suing Apple is pathetic. If I filed a lawsuit every time sprint, att, verizon etc, dropped calls I would be in court all day. It is part of being in the first 25 years of this wireless revolution. The whining has to stop! People are so self-entitled and expect everything to be done as if they are the only people on the planet. If you throw away your Iphone in a fit Apple won't loose a step. They will be 30,000 more customers who love everything about it next week. I use a blackberry, works fine and does what it does. Can't get too hung up on feeling betrayed if I drive into a tunnel and it drops my call.

    I think it is rediculous that At&t "MAKES" you get I tunes to use the I Phone...... After purchasing this phone I found out that you have to purchase I tunes, I do not have a credit card and they do no accept debit cards therefore I can not use this phone. I don't even have a use for I Tunes, I just wanted the phone and if I did want to order I tunes they would have come directly out of my checking accout.

    jirojas obviously has never used an iphone. Quirks or no quirks, the iphone is a high quality, extremely useful, cutting edge, stylish phone. I wouldn't trade mine for any other device on the current market.

    #1. isn't there a clause in the conract that say "if u r not satisfied for any reason, return it for a refund"? #2. how about u all just put down your phones and talk to your friends IN PERSON! u'll never drop a call, ever. i guarantee it. all of this dependence on technology contributes to the social deacy that is so prevolent in our society. this article is a perfect example. rather than working out his problemsand getting what he wanted out of the deal, which is a new phone, the guy decides to try and profit from it! it's nonsense, really.

    u ppl b**ch 2 much nothing is perfect in life....there will be problem in elections...if u listen what steve jobs said ..he said that some area will get 3G like in my area i have it all the time.. and my iphone work fine...no drop call....no chack on my (white) iphone..the guy that telling 2 sued at&t and apple he just pissoff because he life in a wrong area... that it...just remember elections is NOT perfect okay...apple and AT&T will DO the BEST they can 2 FIXED the prooblem for us customer im with at&T for 5yrs and so fall i love the company...1st time with APPLE company

    The last product Apple mad was the Apple //gs, since then it has all been crap.
