Faced with crushing deficits, depressed tax revenues, and a grim outlook for 2009, states across the country are taking another hard look at taxing interstate sales completed on the web. Once a strict "no tax" zone, those walls are now on the verge of crumbling.
Following the lead of tax-hungry New York, 22 states and hundreds of retailers have joined a group called the Streamlined Sales Tax Governing Board. The goal of the group is to simplify the methods by which sales taxes are calculated, collected, and transmitted online by creating a set of tax rules that rolls the thousands of state, county, and city tax codes into a single, simplified code. And the SSTGB also wants to make those rules apply to all online purchasers, even those across state lines, not just buyers in the same state as the seller's offices.
The SSTGB already has some of the biggest retailers around in its pocket, including Wal-Mart, Borders, and J.C. Penney.
Of course, not everyone is thrilled about the prospect of the e-taxman. Amazon is famously suing New York for its requirement that the company collect sales taxes for all sales to New York, despite the fact that Amazon doesn't have a physical presence there. It is collecting those taxes, though, in the meantime, as the case works its way to court.
Overstock, however, is not collecting those taxes, having fired 3,400 of its New York-based affiliates in order to skirt the NY legislation. (The recently-enacted law claims that locally-based "affiliates," which collect a commission on referrals for sales of products sent on to a third-party retailer, constitute a physical nexus in the state and thus make the retailer responsible for tax collection.) Overstock is also suing New York over the law.
What happens now? More waiting and negotiating for the forseeable future. As Forrester analyst Sucharita Mulpuru notes, "It's a legal morass. In a best-case scenario, it's going to take a while to sort everything out."

The Internet is still cheaper, has better service, and if you're willing to wait - not a common American trait you can get free shipping from some places. My friend does that through Amazon all the time.
This is GREAT news! Our country needs change and Balack Obama is providing change. We need to tax everything because that would be ... "Change"
idighairspray, no, but it doesn't matter, it will apply to CA as well. I posted a large post that explained the REAL issue, but it hasn't appeared in over an hour, so perhaps they will not post it. The short version, you all owe the tax, it's called a use tax. You always have and always will. It's not Bush or Obama, or anyone else at the Federal Gov't level. These are state taxes. If the Internet sellers don't collect them, you still owe them. If SSTP does not pass, your state will audit you and charge you with the tax, interest and penalty.
I volunteer to show these states how to balance a budget!! Afterall, I have plenty of experience balancing my budget, in spite of being taxed out the ying-yang. If you spend more money than you have and go bankrupt, there's no "bail out". Does anyone else live in a rural area which would require more than an hour's drive to get to a retailer who might have the item needed?

little more in your local stores. Those local stores pay taxes that pay major portions of your school and other taxes. Without those industries you pay much more in taxes locally and send your money over the internet to places that the money will not be returning and benefiting your community. Its time to wake up and support your local stores and not loose the people who have supported you all these years. You will end up with a ghost town as this all trickles down with people loosing their jobs and communities collapsing.

Sorry to disagree with some of you who made good points. I am sixty years old, laid off my job of 10 years from experience and being a history buff this is expected. it has been a long time coming and now that the democrats are in power taxes are going to go up one way or another. Yes you will get a tax cut here or there but your overall tax increases will negate that gain. Mr. Obama is already backing down from promises ...big surprise!! Your taxes will go up in subtle ways like this so you will be snowed into thinking they have gone down. The truth is the country is out of money. The government is bailing out everyone ....just who do you think is going to pay for all this...maybe Caroline Kennedy (isn't it Schlossberg?) could just donate some of her funds since she thinks she can help us all.
Ever wonder how we not only ran this country years ago, but also built schools, roads, buildings, etc on a fraction of a percent of todays taxes??? Many states didn't even have income or sales taxes.
Wow! How about everyone just shut the heck up? Stop blaming ideologies, get over culture-war grudges and look at the broader picture: Individual tax revenues matter very little compared to the CORPORATE taxes that should be delivered into state and federal treasuries. Unfortunately, thanks to deregulation and an endlessly loopholed tax code, most significant corprate entities actually receive large annual windfalls and incentives - instead of writing those grim tax payment checks that most of us citizens have to write each year. I see Wal-Mart, Borders and JC Penney are fans of this "internet tax" idea. Well, here's a counteroffer: Why don't we turn some of the multinational signatories to this proposed law upside down, and see how much change falls out of those deep pockets for once? Since they're not paying for healthcare or a living wage or anything...

Gee, at the risk of sounding sheepish I must admit I do agree with d.faraday108's post. He/she gets the point: as long as the government can keep us at each other's throats, it will only become stronger, our individual rights will continue to erode and our tax burden at both the state and national level will continue to keep us slaves to the folks we elected. Maybe we ought to call a time-out on the Dem vs. Republican war and see that both sides risk losing their freedom and money.
Hey strodus #51 . . . so, basically, you're not breaking the law if you don't get caught? I guess you don't like taxes OR laws -- good luck with that! In any case, you miss the point: states aren't creating a new tax here, they're trying to collect the sales tax you already owe that you're not paying.
Wow I can see that Bush hate is going nowhere soon, however let me talk to these people for a minute Bush has nothing to do with sales/state taxes that is Congress and the House. New York is a liberal/democrate state get with the intelligence train and read a little bit. These retailers are pulling the strings because they are greedy and becaues they cannot deal with competititon. This is capitalism and they can't deal with it so they are using the government to hit people in the pockets those that buy online. This is disgusting. This is the reason why big government is not a good idea.
WOW what a great idea! No more free shipping..cant afford it, no more discounts..cant afford it no more income...cant afford it either. How about we have a very serious audit of all Government agencies starting with the IRS. How many are driving Government vehicles and flying on tax payer money? Lets see those expense accounts real close. what about those who "Place thier spouse on 3 figure incomes because they answer the phone at home or make them a sandwich, Blah blah blah. What goes around comes around. This will result in an awesome amount of legal fees that we pay for...real smart. Screw the working class so the rich get richer.

OK EVERY, Only in America can we be in a Huge economical mess that we are in NOW. Government had this all planned out to put us in a recession. We are not go to get any better soon. If they pass the Internet Tax, does that mean anything we buy overseas will be taxed ALSO???!!!! That are not solving the crisis we are in now. Everyone must work together. Executives, CEO, UPPER MGMT, MGMT should take a huge cut in pay. All the Government wants to do is pass the buck on to the little people and STILL rob us of even more money. With millions of people out of work, those people are trying to find work or trying to earn a living on BUYING, SELLING goods they have to supply for their family. With this INTERNET SALES TAX, isn't that why they created the extra charges CALLED: SHIPPING & HANDLING???

Well, the solution will be simple. These companies could simply move their warehouses to Mexico and their headquarters to Canada.
