An Alabama woman has filed a class-action lawsuit against Apple over the iPhone 3G's reception woes—and judging from the number of complaints I've been hearing about the new iPhone, she may end up with plenty of company.
According to AppleInsider, Jessica Smith of Birmingham, Alabama filed the lawsuit on Tuesday, and she accuses Apple of false advertising for claiming that the "defective" iPhone 3G is "twice as fast at half the price."
In the suit, Smith complains that her iPhone 3G suffered from an iffy data connection "immediately after purchase"—and indeed, if you check out the comments on my recent post about the iPhone's iffy reception, Smith isn't the only one.
Apple has finally admitted—tersely—that a software patch released Monday (iPhone software 2.0.2, to be exact) was intended to "improv[e] communication with 3G networks." But from what I'm hearing, many iPhone users are still suffering from poor 3G reception and dropped calls after installing the patch.
For my part, my iPhone 3G was working fine until I installed the update; now, my handset keeps flipping to EDGE mode in areas where I'd previously been getting a 3G signal, Web pages are taking longer to load, and e-mail trickles in at a snail's pace. (Oh, and another thing—remember those hairline cracks appearing in some iPhone 3G cases? I've got one now, too.)
OK, so is Smith just being greedy by filing a class-action lawsuit? Maybe, maybe not, but I can understand her frustration.
Speaking purely as a user who spent $299 on a new iPhone, I'm pretty annoyed that its key new feature—3G—is on the fritz, and I'm even more annoyed that Apple seems so reluctant to communicate its with loyal customers.
Well, given that iPhone users may soon be banding together for a lawsuit, it looks like Apple (or its legal team, at least) will finally have to sit up and listen.

I have had no problems with my Iphone so far, maybe some states. So far I am very happy with mine. P.S. no craks !!!
she has all the right in the world to file a suit, but you dont know if its the 3G network thats not working or the EDGE network is doing something weird or whether it really is Apple's problem. Until that question is answered she cant make a legitimate argument, no one can complain, and its going to be a while before any one gets payed money, an update comes out or something gets replaced. just pitching an idea.

Okay I understand if your upset with the company but I don't think it's neccesary to sue them for that
my iphone works perfectly service wise. turn off the 3g!!! i always have 5 bars with edge

I would hope that she can't return the phone...otherwise a class action lawsuit is somewhat absurd. Furthermore, anyone interested in a high tech gadget like the iPhone should now that tech companies like Apple, Intel, Microsoft often exaggerate/mislead when marketing to the public. Considering an iPhone with internet access would cost over $2000 in a two year contract, that makes it a poor value for someone who is going to be mostly talking on the phone and texting. I'm lucky that I don't have to pay for my cell phone service but I'd like to see a company offer 10 hours of web browsing, 200 text messages and 400 minutes plus free nights and weekends for $40 per month.
I wish someone would make a cell phone that would simply equal "land-line" reception! No need to put all the "kids crap" on it. I don't want my MTV, play stupid video games, take crappy pictures, listen to music, wash my windows etc! I want clear reception first and foremost! Email and internet capability are nice, but come in second to basic telephone RECEPTION! DUH! The company to manufacture a reliable cellular telephone" that you can actually clearly listen and "talk" on will earn my business. Am I the only one out there that desires this? We should have a class-action suit against continual dropped-calls and poor reception.
All I have to say is... AHAHAHAHAHAHAHAHAA. That's what ya'll get for buying Apple's hype (once again). It's really too bad that the collective world's panties go soaking wet every time Apple brings out a new "improved" product. It really helps hide the fact that their products turn to ----- after a year, if they even work to begin with.
Millions upon millions sold and a very few comments or complaints. From my understanding, if the phone isn't working, take it to the local ATT. Mine works fine..all aspects, 3G, everything else. ----- ----- ----- .. You read about this stuff, and all the other little items. If you go to Balckberry columns, you see basically the same people with similar problems. Then some columnist, "with nothing better" to do decides to chime in. I'm sick of the whiners. Go buy something that isn't getting a Cell Phone complaint! Good Luck finding one if any! try being positive about something. Like....Hey I can afford an Iphone! Sheez!

Good job to that woman. I have a 3g iphone and I'm about to return it next week. I have a 30 days trial and I been having problems with it every day since I bought it 10 days ago. The blame goes to apple not att. My friend has att and he had 3bars on his 3g ATT tilt where as my iphone had 0 bars. Apple need to learn their lesson because the only thing they like to do is rip people off left and right.

Suing the wrong person. Apple makes the product, and you pay ATT for service. Therefore, any problems with service defaults to ATT.
Its the crappy 3G network that ATT has rolled out to blame, Verizon has been running 3G for years. Cant wait for iPhone to roll out on Verizon and use it, how it was meant to be used.

thats right.i believe all the iphone user also do the same if they know how to claim back to apple. i want buy a iphone but for this situation my instint to buy is low.wait and see..
