As complaints over dropped calls and slow performance continue to nag Apple following its iPhone 3G launch, at least one man has become angry enough to file a lawsuit, saying that Apple and AT&T have misled consumers by not just selling a device that "requires too much power" but that the two companies have sold so many devices that they are now flooding the AT&T network and slowing it down for everyone.
The idea of flooding a cellular network isn't far-fetched, but so far there's only limited evidence that this is really happening. (I expect we won't likely know the extent of any such issue until iPhone 3G sales start to peak.) But the litigious William Gills has this response covered too, saying that even without the flooding, Apple has exaggerated performance data since the launch of the first iPhone, complaining that it never performed as well as the company said it would even on the old EDGE network.
For its part, Apple has defended performance on the handsets and as "great," but this is actually the second lawsuit the company has attracted in the last couple of weeks from upset buyers. Both suits appear to be seeking class action status.
While every new product invariably seems to attract lawsuits when expectations don't measure up exactly to what was promised in advertising, the iPhone has sold so many handsets so quickly that it's getting more than its fair share of attention from the legally minded.
There's no telling whether these suits will stick, but given the growing mountain of gripes on the web, it's hard to imagine we won't see Apple and AT&T offering some kind of settlement to iPhone buyers down the road. (My bet for what they'll eventually get in, oh, three years or so: a $10 credit at the iTunes Store.)

The only decent Apple product are its computers the ipod and iphone are overhyped and mediocre. There are better products on the market for mp3 players and cell phones.
Im glad I dont have an iphone. The old school Treo works for me.
The iPhone is BOGUS it hate AT&T. It makes me sick that our government allows companies to take advantage of consumers. shame on both Apple and AT&T
well, since we all know apple overhypes everything how about we stop buying their crapy products so they stop releasing substandard products there are so many better cell phones and mp3 players which are cheaper by at least half the price
the iphone is slow but not completely bad. whats horrible is at&t . their service sucks, because... well there is never any service. why apple would choose to sell exclusivly through at&t is just stupid. at least if thy sold through verizon peploe would be happy with the service they get.
Like or hate the iPhone, or Apple, everyone should be able to admit that this lawsuit is stupid and completely without merit. A better solution would be to round up these worthless lawyers who do this, their client, and any morons who agree with this kind of nuisance lawsuit, and use them as boat anchors.
I mean yeah...the iPhone is pricey,the lines are pricey,but really,thats stupid.Nowadays,people sue for almost anything that they can think of
I don't care, I love my iphone and I wouldn't trade it for any other phone.
i agree with 8 and 9. this is one of the most absurd law suits i have ever heard of and its these money hungry pieces of (explitive) that are destroying our legal system. if your unhappy with your over priced phone too dam bad. should have thought about that before you spend all that money in the first place.

Apple and at&t charge too much for their product plus they hype up to get people to buy their product, Even thought both company are to blame it is the customers fault for giving in.
